Privacy Policy & Disclaimers

Effective Date: 1 May 2026 | Last Reviewed: May 2026

1. Introduction

This Privacy Policy ("Policy") is issued by MumNest ("we", "us", or "our") and governs the collection, use, disclosure, storage, and management of personal information in connection with the MumNest mobile application and associated website located at MumNest.app (collectively, the "Services"). This Policy has been prepared in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs") contained in Schedule 1 of that Act, as maintained and updated by the Office of the Australian Information Commissioner ("OAIC"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. If you do not agree with the terms herein, you must immediately discontinue your use of the Services.

2. Open & Transparent Management

We are committed to managing personal information in an open and transparent manner. This Policy sets out clearly how we collect, hold, use, and disclose personal information. We will take reasonable steps to make this Policy available free of charge upon request, and it is publicly accessible via our website. Any significant changes to this Policy will be communicated to users in advance of their implementation.

3. Anonymity & Pseudonymity

Where it is lawful and practicable to do so, we will offer individuals the option of engaging with the Services without identifying themselves or by using a pseudonym. However, certain features of the Services — including account creation, personalised AI-generated reports, and baby tracking — require the collection of identifiable information to function correctly. In such cases, it is not reasonably practicable for us to deal with an individual on an anonymous basis.

4. Collection of Solicited Personal Information

We only collect personal information that is reasonably necessary for, or directly related to, one or more of our functions or activities. We collect personal information by lawful and fair means, and where reasonable and practicable, directly from the individual concerned. The categories of personal information we collect include:

  • —Account Information: Your name and email address provided at the point of registration.
  • —Baby Tracking Data: Feeding logs, sleep records (including night-time sleep and daytime naps), weight and growth measurements, and diaper entries entered by you on behalf of your child.
  • —Location Data: Approximate device location, collected solely to generate localised weather information within the application's weather card feature.
  • —Device & Usage Data: Device identifiers and anonymised usage analytics, collected to maintain, improve, and optimise the Services.

We do not collect sensitive information (as defined under the Privacy Act) unless you voluntarily provide it and we have obtained your express consent.

5. Dealing with Unsolicited Personal Information

In the event that we receive personal information that we have not solicited and which we determine we could not have collected under APP 3, we will, within a reasonable time, destroy or de-identify that information, provided it is lawful and reasonable to do so.

6. Notification of Collection

At or before the time we collect personal information, or as soon as practicable thereafter, we will take reasonable steps to notify you of the purposes for which we are collecting the information; any third parties to whom we ordinarily disclose the information; and the existence of this Policy and how to access it. This notification obligation is satisfied, in part, by the publication and accessibility of this Policy.

7. Use or Disclosure of Personal Information

We will use or disclose personal information only for the primary purpose for which it was collected, or for a secondary purpose where you have consented, where you would reasonably expect such use or disclosure, or where otherwise required or authorised by law. We do not sell, rent, lease, or otherwise commercially exploit your personal information to any third party under any circumstances. Personal information may be used to: provide and improve the Services; generate personalised AI-driven insights, reports, and recommendations; display contextually relevant weather data; and conduct anonymous, aggregated product analytics.

Testimonials & Reviews

From time to time, MumNest may publish testimonials or reviews provided by users on our website or in promotional materials. We will only publish a testimonial or review after obtaining your express permission. With your approval, we may make light edits for clarity or length, and may include attribution such as a first name or photograph only where you have separately consented to that use. You may request that we edit or remove your testimonial or review at any time by contacting us at privacy@mumnest.app, and we will action that request promptly.

8. Cross-Border Disclosure

Where we disclose personal information to overseas recipients (including cloud infrastructure and service providers), we take reasonable steps to ensure that those recipients do not breach the APPs in relation to that information. Before disclosing personal information overseas, we will take such steps as are reasonable in the circumstances to ensure the recipient is subject to a law, binding scheme, or contract that effectively upholds privacy protections comparable to those under the APPs.

9. Access to Personal Information

You have the right to request access to personal information we hold about you. We will respond to such a request within a reasonable time and provide access in the manner you request, if it is reasonable and practicable to do so. Access may be refused on grounds permitted under the Privacy Act, in which case we will provide written reasons for the refusal.

To To permanently delete your account and all associated data, navigate within the MumNest application to: Settings → Danger Zone → Delete Account. 10. Correction of Personal Information

If you believe that personal information we hold about you is inaccurate, out-of-date, incomplete, irrelevant, or misleading, you may request that we correct it. We will take reasonable steps to correct the information within a reasonable time. If we decline to make a correction, we will notify you in writing with our reasons.

11. Data Security

We take reasonable steps to protect personal information from misuse, interference, loss, and from unauthorised access, modification, or disclosure. All data transmitted through the Services is encrypted using TLS/HTTPS protocols and stored in secure, encrypted databases hosted by reputable infrastructure providers. We conduct periodic reviews of our security practices and will notify affected individuals in accordance with applicable law in the event of an eligible data breach.

12. Children's Data

The Services are designed exclusively for use by adults — specifically parents, guardians, and caregivers. MumNest does not knowingly collect personal data directly from children under the age of 13. Baby-related tracking data entered by a parent or guardian on behalf of a child is processed solely to provide the Services to that parent or guardian and is afforded the highest degree of care and confidentiality. If you have reason to believe that we have inadvertently collected data from or about a child without appropriate authorisation, please contact us immediately so that we may take prompt remedial action.

13. Contact & Privacy Enquiries

For any enquiries, complaints, access requests, or concerns relating to this Policy or the handling of your personal information, please direct correspondence to our privacy contact using the button below. Disclaimers

Terms of Use & Limitations

14. Disclaimers — General

The following disclaimers apply to all users of the MumNest mobile application and website. By accessing or using the Services, you acknowledge and accept the disclaimers set out in Sections 14 through 20 of this document. These disclaimers are intended to define the boundaries of the Services and to limit the liability of MumNest to the fullest extent permitted by applicable law.

15. No Medical Advice — Limitation of Liability

The MumNest application has been developed to assist parents and caregivers in the organisation and tracking of their infant's daily routines and developmental data. The Services are provided for general informational and convenience purposes only.

Nothing contained within the Services constitutes, or is intended to constitute, medical advice, clinical diagnosis, medical opinion, professional healthcare guidance, or a substitute for consultation with a qualified medical practitioner.

If you have any concerns regarding the health, development, safety, or wellbeing of your child, you are strongly advised to seek immediate and appropriate advice from a qualified General Practitioner, registered paediatrician, licensed healthcare provider, or — in the event of an emergency — present to your nearest hospital emergency department without delay.

MumNest, its officers, employees, contractors, and affiliates shall not be held liable, whether in contract, tort (including negligence), statute, or otherwise, for any injury, illness, loss, damage, death, or adverse outcome sustained by any person — including any infant or child — arising directly or indirectly from the use of, reliance upon, or inability to access the Services.

16. AI Weekly Report — Nature & Limitations

The AI Weekly Report ("Report") generated by the Services is an automated, algorithmically produced summary intended solely as a general guide to assist parents and caregivers in navigating their infant's routine. The Report constitutes a suggestion only and does not represent clinical advice, a professional assessment, or a diagnostic conclusion of any kind.

  • —Sleep Logs — inclusive of both night-time sleep periods and daytime nap intervals;
  • —Feeding Logs — encompassing all feeding sessions, volumes, and types;
  • —Weight Logs — recorded at regular intervals to reflect accurate growth data.

The accuracy and utility of the Report is materially dependent upon the completeness and regularity of data entered by the user. MumNest makes no warranty, express or implied, as to the accuracy, suitability, or fitness for purpose of any AI-generated content produced by the Services.

To enable the generation of a Report of the highest possible quality and accuracy, users are strongly encouraged to maintain consistent and comprehensive data logs, including:

17. AI Report — Bedtime Routine Suggestions

The AI Weekly Report may, from time to time, include a recommendation to adjust your infant's bedtime routine settings via the Baby Profile section of the application. Such recommendations are generated algorithmically on the basis of the sleep data logged and tracked within the Services and are intended as a supportive suggestion only. Users retain full discretion as to whether to implement any such recommendation. MumNest does not warrant that any suggested adjustment will produce a particular outcome and accepts no liability for any consequence arising from the implementation or non-implementation of such suggestions.

18. AI Training & Report Feedback

MumNest's AI reporting capabilities are in active development. As the volume of user data increases over time, the precision and relevance of AI-generated outputs is expected to improve commensurately. We acknowledge that, during this period of ongoing development, the Report may occasionally produce outputs that are imprecise, incomplete, or otherwise unsatisfactory.

In the event that a user identifies any concern with a generated Report — including, without limitation, issues relating to content accuracy, inappropriate wording, or factual inaccuracies — we respectfully request that such concerns be communicated to us directly via the AI Report Issue button below. When lodging a report, users are encouraged to provide as much detail as practicable, including the relevant baby profile name, screenshots of the issue, and the date and time of the Report in question, to enable a thorough and efficient investigation.

19. Weight Logs & Growth Percentile Standards

Weight percentile calculations within the MumNest application are derived in accordance with the WHO Child Growth Standards (Weight-for-Age), as published and maintained by the World Health Organization. Users should be aware that healthcare providers, hospitals, and paediatricians operating within specific jurisdictions may apply alternative growth reference standards — such as national population-based normative data — that may yield differing percentile classifications. Accordingly, any discrepancy between weight percentile data displayed within the Services and that provided by a treating clinician is not indicative of error but rather reflects the application of a different reference standard. Users are encouraged to consult their healthcare provider for clinical interpretation of growth data.

20. In-App Tutorial Mode

For users who require guidance in navigating the features and functionality of the MumNest application, a Tutorial Mode is available within the Settings section of the application. Tutorial Mode may be activated or deactivated at any time by navigating to Settings → Tutorial Mode and toggling the relevant control. This feature is designed to provide contextual on-screen guidance and may be enabled at any stage of the user's engagement with the Services, including after initial onboarding.
