These Terms of Service ("Terms") govern your access to and use of the MumNest mobile application and associated website located at MumNest.app (collectively, the "Services"), operated by MumNest ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Services.
The Services are intended to support parents, guardians, and caregivers in tracking the daily routines of the children in their care. The Services may also be accessed by younger members of the household — for example, a teenage sibling or young family member — who wish to assist a parent or guardian with logging feeds, sleep, nappy changes, and other routine entries at home. By using the Services, you agree that you do so under the supervision of, or with the consent of, the parent or guardian responsible for the child whose data is being logged, and that any information you provide is accurate and complete.
To access certain features of the Services, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
You agree to use the Services only for their intended purpose — tracking your child's sleep, feeding, nappy changes, and weight data. You must not use the Services for any unlawful purpose, to misrepresent your identity, to interfere with the proper functioning of the Services, or to attempt to gain unauthorised access to any part of the Services or our systems.
You retain ownership of all data you log within the Services, including tracking entries and any information you provide about your child. You grant us a limited licence to process this data solely for the purpose of providing and improving the Services, including generating AI-driven reports. The Services, including any AI-generated reports or suggestions, are provided for general informational and convenience purposes only and do not constitute medical advice, diagnosis, or a substitute for consultation with a qualified healthcare professional. If you have any concerns regarding your child's health or development, you should seek advice from a qualified medical practitioner.
MumNest incorporates a visual sleep cycle wave feature intended to provide a generalised illustration of the alternating deep (quiet) and light (active) sleep phases experienced by infants. This visualisation draws upon established scientific literature concerning the ontogenetic development of infant sleep cycles, including the seminal work of Roffwarg, Muzio and Dement (1966) and subsequent research demonstrating that the proportion, duration, and characteristics of active and quiet sleep differ substantially between newborns and older infants. Notwithstanding this scientific basis, the sleep cycle wave displayed within the Services is approximate only and is intended to serve as a general guide. It is not intended to represent, nor should it be relied upon as, an accurate or real-time reflection of your infant's actual physiological sleep state at any given moment.
The accuracy and practical applicability of the visualisation is materially dependent upon the judgement of the parent or caregiver in determining when the infant transitioned into sleep, as the precise onset and progression of sleep phases cannot be detected by the Services. Every infant exhibits variable sensitivities to environmental stimuli, including noise and movement, and the thresholds at which such stimuli may disturb an infant's sleep are influenced by numerous factors, including but not limited to the presence of intercurrent illness, the achievement of developmental milestones, individual temperament, cumulative sleep pressure, and the prevailing sleep environment.
Parents and caregivers remain solely responsible for the assessment of their infant's sleep state and should not rely upon the visualisation as a substitute for attentive, direct supervision of the infant. No representation or warranty, express or implied, is given as to the accuracy, completeness, or clinical reliability of the sleep cycle visualisation, and MumNest accepts no liability for any reliance placed upon it.
All intellectual property rights in the Services, including the MumNest name, logo, design, and underlying software, are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.
To the fullest extent permitted by law, MumNest, its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Services. The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or engaged in conduct that is harmful to the Services or other users. You may also stop using the Services and delete your account at any time via the app's settings.
We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. Any changes will be posted on this page with an updated effective date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
